MISHPATIM 38 2008 ASSAF HAMDANI & ALON KLEMENT CLASS DEFENSE AND MISTAKEN PAYMENTS F I T he Class Actions Act of 2006 imposes significant restrictions on class action suits against the state. Plaintiffs can presently only file JL class action suits for unlawful payments made to the state. In this Article, we offer what we believe to be a superior mechanism for adjudicating disputes concerning unlawful payments the class defense. Lawmakers, courts, and legal scholars have long recognized that consolidating the claims of dispersed plaintiffs with similar grievances may promote justice and efficiency. In this Article, we argue that justice and efficiency also mandate that similarly positioned defendants be provided with an adequate procedure for consolidating their claims and that the class defense can outperform the conventional class action in arriving at a quick resolution of the dispute while avoiding many of the social costs associated with unlawful payments.
MISHPATIM 38 2008 ISSACHAR ROSEN-ZVI & TALIA FLSHER BEYOND THE CIVIL AND THE CRIMINAL: TOWARDS A NEW PROCEDURAL TAXONOMY The Article challenges the fundamental taxonomy in Israeli case law between civil and criminal procedure. Under the prevailing system, generous protections are offered to criminal defendants even those only accused of misdemeanors, while very few procedural safeguards are offered to civil defendants even those facing severe civil sanctions. This Article surveys the many theoretical justifications, which have been offered for the procedural divide between the two procedures including utilitarian, egalitarian, expressive, and state-centered rationales contesting each while arguing that they are outdated, if not outright erroneous. This Article then reviews efforts made by Israeli courts to grapple with the problems posed by the current civil-criminal procedural dichotomy, and surveys their failed attempts to design clear cut rules for distinguishing between cases where civil procedures should be applied and cases in which criminal procedure is more appropriate. It discusses the transition in Israeli case law from formalism to functionalism in a variety of legal settings including extradition, civil fines, contempt of court and civil forfeiture designed to overcome the abuse of such categorization by the legislature. It demonstrates, however, that the functionalist approach, based on the "purposeful review" suffers from inherent shortcomings both descriptive and normative and, therefore, cannot be seen as viable. The Article then turns to offer a radical yet simple solution: cutting the Gordian knot, i.e., divorcing substance from procedure and replacing the current bifurcated civil-criminal procedural regime with a procedural model divided along different axes: the severity of the sanction and the balance of power between the parties. This model, the Article claims, would better achieve the goals underlying the current procedural regime.
MISHPATIM 38 2008 MICHAEL KARAYANNI CIVIL PRE-TRAIL DISCOVERY IN ISRAEL: TRENDS The Article examines two major trends in Israeli pre-trial discovery rules. The first bars a party from submitting documents as evidence which were concealed by one party from the other at the disclosure stage during the pre-trial discovery phase. The second is the elevating of the uncovering of truth to be the principal objective of pre-trail rules in general. While these trends may be viewed as having a positive influence, they nonetheless raise a number of procedural adversities because these rules originally were designed for other purposes and were in fact transplanted into the pre-discovery phase. This Article seeks to highlight these procedural difficulties and offers various methods for mitigating their influences.
MISHPATIM 38 2008 DAPHNA KAPELIUK TOWARDS A NEW CONCEPT OF THE LIMITS OF JUDICIAL SUPERVISION OF ARBITRATION AWARDS his article proposes a new concept to the limits of judicial supervision of arbitral awards, according to which, the parties JL would be allowed to agree on the extent of judicial control over their award. The proposed concept embodies the idea that the court's role in supervising arbitration awards should be considered as a default that the parties can modify by agreement. The basic ideas employed within this concept were recently adopted in the Arbitration Law.
MISHPATIM 38 2008 OREN GAZAL-AYAL & RAANAN SULITZEANU-KENAN, GAL EINAV & ATALLA SHOBASH JEWS AND ARABS IN PRETRIAL DETENTION HEARINGS f I 1 his study examines the effects of the suspects' and presiding judges' ethnic identities on pretrial detention decisions. While JL previous studies on the effect of ethnicity concentrated on the sentencing stage, this study is the first to examine its influence on the pretrial detention hearings in Israel. The pretrial detention hearing is unique in that at this initial stage of the criminal process judges have limited information on the case as well as the defendants; the hearing itself is short; and the police's position on the amount of time needed to conduct an investigation, allows for better statistical control over other information on the judge's decision. This study is different than previous studies in that it also controls for the ethnicity of the judges, and excludes agreements between the prosecution and the defense allowing for the reduction of spurious associations. The results of the study show that in the cases the judge was Jewish, a Jewish suspect was more likely to be released on bail than an Arab suspect, and in the case the suspect is Jewish, his chances of release by a Jewish judge was higher than his chances of release by an Arab judge.
