The Mitzvah of Mezuzah
Questions: Week 77 The correct height to put the Mezuza? Who is appropriate to write a Mezuza? Can a woman put up a Mezuza? How about a child?
There is a positive Torah commandment to write the two paragraphs of Shema Yisrael and Ve Haya Im Shamo a on parchment and affix this parchment on the doorpost of one s home, as the verse states, And you shall write them on the doorposts of your home and on your gates. The Merit of the Mitzvah: Our Sages taught (Menachot 43b) that anyone who has Tefillin on his head and arm, Tzitzit on his garments, and a Mezuzah on his doorpost is assured not to sin, for one has many reminders of Hashem s presence. These Mitzvot are the angels which protect one from sinning, as the verse states, The angel of Hashem camps around those who fear Him and saves them. In the merit of the Mitzvah of Mezuzah, one s entire household is protected from harmful entities. It is for this reason that we write שומר דלתות for name of Hashem on the Mezuzah, for this is an acronym שדי the Israel. Protector - ישראל of the doors of
May a woman put up a Mezuza? Those Obligated in the Mitzvah of Mezuzah-Women All must be careful regarding the Mitzvah of Mezuzah, for everyone is obligated to perform this Mitzvah. Women are also obligated in this Mitzvah just as they are obligated to perform other Mitzvot. This is derived from the juxtaposition of the verses, And you shall write them on the doorposts of your home and on your gates. In order for your days and the days of your children to be increased etc. Our Sages expounded (Kiddushin 34a and Yoma 11b) that women likewise require life and are therefore obligated in the Mitzvah of Mezuzah. Some say that a woman should not affix a Mezuzah on her own. Nevertheless, Maran Rabbeinu Ovadia Yosef zt l writes (in his Halichot Olam, Volume 8, pages 201 and 216) that this is incorrect and a woman may, in fact, affix a Mezuzah while reciting a blessing, just like a man.
May one allow his younger son/daughter (who is not bar/bat mitzvah) to put up a mezuza? How about in his/her own room? Children Regarding the Mitzvah of Mezuzah The Rambam (Chapter 5 of Hilchot Tefillin and Mezuzah) writes: Children are educated to affix a Mezuzah in their houses. This means that a Mezuzah should be affixed onto a house where children live (such as a dormitory), for although children are exempt from the Mitzvah of Mezuzah, they should nevertheless be educated to fulfill it just as they are educated to fulfill other Mitzvot. A Mezuzah should therefore be affixed to children s rooms. This is especially true since Mezuzah is unique in that every time one passes it, one is reminded of the oneness of Hashem s holy name, the love of Hashem, and that nothing remains forever besides for the knowledge and belief in the Master of the Universe. Additionally, the Mezuzah is auspicious in that it protects those living in the house. When a Mezuzah is affixed in the house, one should not allow a young boy or girl (under the age of Bar/Bat Mitzvah) to affix it, for their affixing does not exempt adults from the Mitzvah of Mezuzah.
Whom to Purchase a Mezuzah From The scribe who writes one s Mezuzah must be completely G-d-fearing. Because the laws of Mezuzah are complex, one should only buy a Mezuzah from a scribe or a salesman who is known to be completely G-d-fearing. The same applies to Tefillin and Sifrei Torah which should only be purchased from an expert scribe who is completely G-d-fearing. It is preferable for a Sephardic Jew to use a Sefer Torah and Mezuzah written in Sephardic handwriting. The law for Tefillin, however, is somewhat different and a Sephardic individual must make certain to don only Sephardic Tefillin, for there are nuances regarding the writing of Ashkenazi Tefillin which invalidate most of them according to the ruling of Maran Ha Shulchan Aruch.
The Correct height to Affix the Mezuzah Question: At what height should the Mezuzah be affixed onto the doorpost? Answer: The Gemara (Menachot 33a) and the Poskim state that the Mezuzah should be affixed at the beginning of the top third of the doorpost, i.e. the doorpost should be divided into three equal parts and at beginning of the top third (from bottom to top) is the correct place to affix the Mezuzah.
The Rishonim disagree regarding whether or not one who has affixed the Mezuzah under the top third of the doorpost, such as if one has placed the Mezuzah at the mid-point of the doorpost, has fulfilled one s obligation. According to the Rosh, one has indeed fulfilled one s obligation. According to the Rambam, on the other hand, even if one has done so already, one does not fulfill one s obligation and one must remove the Mezuzah and affix it in the correct place. Halachically speaking, Maran Ha Shulchan Aruch (Chapter 289) rules in accordance with the Rambam s opinion and writes that one must affix the Mezuzah specifically in the beginning of the top third of the doorpost and if one mistakenly affixes it any lower, one must remove it and reaffix it in the correct place. We must now discuss a scenario where the doorway of the house is extremely high in which case affixing the Mezuzah to the beginning of the top third of the doorpost will still be very high up and kissing the Mezuzah when entering or exiting the house, as many are accustomed to, will be difficult or impossible. Should the Mezuzah, in this case, be affixed to a height where people can reach it and kiss it or should it be affixed to the top third of the doorpost even in this case?
Halachically speaking, Maran Rabbeinu Ovadia Yosef zt l writes (in his Halichot Olam, Volume 8, page 248) that the Mezuzah must always be affixed at the beginning of the top third of the doorpost and one may not veer from the ruling of Maran Ha Shulchan Aruch and all of the other Poskim who rule that one must do so even if this means that one will not be able to kiss the Mezuzah as is customary. Summary: In all situations, the Mezuzah must be affixed at the beginning of the top third of the doorpost, as we have explained.
One who placed a Mezuza in the wrong place?
Question: I just realized that in my house, the Mezuzah was placed lower than the top third so that the children would be able to kiss it. What should I do? Answer: Indeed, the Mezuzah must be affixed at the beginning of the top third of the doorpost. We must nevertheless point out that if it was affixed any higher than this point, one fulfills one s obligation as long as there is still a little more than eight centimeters (approximately 3.1 inches) between the Mezuzah and the top of the doorpost. One who acts stringently and affixes the Mezuzah precisely at the beginning of the top third of the doorpost is especially praiseworthy. (Halichot Olam, Volume 8, page 253) Regarding the above question, if one has affixed the Mezuzah lower than the top third of the doorpost, such as one who has affixed the Mezuzah to the midpoint of the doorpost so that the children are able to kiss the Mezuzah, and now realizes that this custom is mistaken, one must certainly remove the Mezuzah and reaffix it in the correct place which is at the beginning of the top third of the doorpost. Maran Rabbeinu Ovadia Yosef zt l writes that since according to Maran Ha Shulchan Aruch one who affixes the Mezuzah anywhere lower than the top third of the doorpost has not fulfilled one s obligation, one who has mistakenly done so and now removes the Mezuzah to affix it to precisely the top third of the doorpost must recite the blessing of Asher Kideshanu Be Mitzvotav Ve Tzivanu Likbo a Mezuzah since until now, the Mezuzah was affixed in a halachically invalid manner (ibid. page 257). Similarly, if one mistakenly affixes the Mezuzah to the left doorpost when entering the house, just the opposite of the well-known Halacha that the Mezuzah must be affixed to the right doorpost when entering the house, and now realizes one s error, one must remove the Mezuzah and reaffix it on the
correct side while reciting the blessing before doing so since the Mezuzah was affixed in a halachically invalid manner until this point. Summary: If one mistakenly affixed the Mezuzah lower than the top third of the doorpost or if one affixed the Mezuzah to the left doorpost as opposed to the right, one must remove the Mezuzah and reaffix it in the correct place while reciting the blessing of Asher Kideshanu Be Mitzvotav Ve Tzivanu Likbo a Mezuzah before doing so.
