24/5/15 נייר עמדה: זנות בקרב בני נוער, צעירות וצעירים בישראל מניעה, מענים, ושיקום מוגש למזכירות הוועדה לזכויות הילד באו"ם UN CRC's review of Israel compliance with OPSC THE HEBREW VERSION WILL BE FOLLOWED BY AN ENGLISH ONE 1. עלם עמותה לנוער במצב סיכון, רקע. עמותת עלם פוגשת בשנה כ- 20 אלף בני נוער צעירות וצעירים )13-26( על רצף הסיכון בפריסה ארצית של כ- 40 ישובים מתוך 270 רשויות קיימות בישראל. מתוכם כמה מאות מדווחים על מעורבות בזנות או נמצאים בחשש גבוה למעורבות בזנות על תצורותיה השונות. עלם מפעילה תוכניות למען נוער בזנות החל משנת 2001, תחילה בעיר תל אביב שהיא עיר מטרופולין גדולה ובה ריכוזים גבוהים של אוכלוסיות בשוליים החברתיים, בין היתר של נוער וצעירים חסרי בית, מעורבים בזנות ונפגעות אלימות מינית. בשנת 2008 הורחבה התכנית בסיוע כספי חלקי של משרד הרווחה גם לערים חיפה בצפון הארץ ולעיר אילת העיר הדרומית ביותר בישראל המאופיינת גם בתיירות גבוהה ועל כן גם ריכוזי הזנות בעיר זו הן מהגבוהות בישראל. בשנת 2013 הוקמה תכנית נוספת לנערות על רצף הזנות בעיר פתח תקווה בהפעלה מקצועית של עמותת עלם ובמימון מלא של משרד הרווחה, משרד הקליטה, המוסד לביטוח לאומי והרשות המקומית. תוכנית זו היא תוכנית ייחודית שפותחה על ידי עמותת עלם להתמודדות עם התופעה בערים בינוניות בהן הזנות אף יותר קשה ומאתגרת לאיתור, זיהוי וטיפול. תוכניות אלו פעולות עד היום בשיתוף פעולה מלא בין עמותת עלם למשרד הרווחה והרשויות המקומיות. חלק מבני נוער אלו אנו פוגשים בתוכניות הייעודיות לאיתור וסיוע לנוער בזנות דוגמת תוכניות בתל אביב, חיפה ואילת, וחלק בתוכניות אחרות של עמותת עלם שאינן ייעודיות לטיפול בנוער בזנות. תופעת הזנות בקרב בני נוער סובלת מתת דיווח והיא תופעה שקשה לאיתור אפילו בקרב עובדי נוער מיומנים ומקצועיים. 2. בני נוער המעורבים בזנות בישראל מאפיינים עיקריים. בשנת 2014 פרסם משרד מבקר המדינה דו"ח שבחן טיפולן של כ 11 רשויות מקומיות בישראל את תופעת הזנות בקרב בני נוער. מבין המלצות המבקר חלקן יושמו באופן חלקי וחלקן טרם. ניכר פער בין הרשויות השונות, קיימות רשויות שמתמודדות באופן אקטיבי ואפקטיבי עם התופעה ומודעות אליה באופן מלא לעומת רשויות שטרם נקטו פעולה כזו או אחרת לאיתור נוער המעורב בזנות כל שכן קידמו חשיבה מקומית כיצד ניתן לצמצם את התופעה ולסייע לאלו המעורבים זנות.
קיים צורך בוער להרחיב את המענים הטיפוליים המיועדים לבני נוער בזנות או בחשש גבוה להיות בזנות לרשויות נוספות בישראל שכן הפריסה של התוכניות הקיימות כיום בישראל אינם מצויים בפריסה ארצית מספקת על מנת להתמודד עם התופעה ברמה הארצית. 3. יישום הפרוטוקול האופציונאלי בישראל - זיהוי, העמדה לדין של עבריינים ושירותי מניעה ושיקום. 3.1 העלאת מודעות, שירותי מניעה וחברתיים לנפגעים - סעיף )2( 9 + )3( בשלושת השנים האחרונות ניכרים מאמצי המדינה ללמוד על התופעה ולצמצם את נזקיה בכל הרמות. אנו עדים למגמת עלייה חיובית בדרישה של המשרדים הממשלתיים והרשויות המקומיות להכשרות מקצועיות בנושא מטעם עמותת עלם, כמו גם לחשיבה ופיתוח מענים מקומיים במשותף. דוגמא יוצאת דופן לשיתוף הפעולה הבין מגזרי התרחשה במהלך 2014 בהקמה והפעלה של מענה ייחודי הפועל 24/7 על בסיס הניסיון המקצועי של עמותת עלם עם נוער בזנות בעשור האחרון, במימון מלא של משרד הרווחה ובשיתוף פעולה עם הרשות המקומית בתל אביב.תקציב הפרויקט המשותף בתל אביב הינו 5 מליון לשנת תקציב אחת המאפשר מענה נגיש, זמין, מקצועי, מגוון, הן לאיתור וזיהוי בני נוער בזנות בזירות הזנות השונות והן למתן סיוע אפקטיבי עד כדי יציאה הדרגתית מעולם הזנות. רכיבי התכנית כוללים: 1. מרחב בלתי פורמאלי להפחתת נזקי הזנות 2. קו סיוע אינטרנטי וטלפוני זמין 3. 24/7 עבודת רחוב ואיתור בזירות הזנות השונות 4. מודל ייחודי של ליווי וקשרים בין אישיים 5. שלטר לצעירים וצעירות בזנות המספק מענה הלנתי חרומי 6. תכנית מעטפת כוללנית ומותאמת אישית לתמיכה ושילוב בני נוער בזנות מחוץ לעולם הזנות. במהלך 2011-2012 נערכו הכשרות לאיתור בני נוער בזנות לכלל הצוותים המקצועיים בעמותת עלם ולאחר מכן אותרו ע"י הצוותים בעלם כ- 621 בני נוער, צעירות וצעירים )13-26( אשר היו מעורבים בזנות., ממוצע הגילאים עמד על 16.7. מתוכם כ- 471 נערות וצעירות וכ- 124 נערים וצעירים בפריסה ארצית של כ- 40 יישובים. אמנם ריכוזי הזנות שאותרו היו בשלושת הערים הגדולות בישראל ובערים בהן הופעלו כבר תוכניות ייעודיות לנוער בזנות אולם גם המספרים שאותרו בערי ספר מרוחקות שאין בהן תוכניות מסוג זה העידו על צורך בוער להקמת מענים ייעודיים עבור נערות ונערים שאותרו בזנות. על בסיס ניסיון מוצלח זה במהלך 2014 הוכשרו על ידי עמותת עלם כ- 320 עובדות סוציאליות ממשרד הרווחה ייעודיות לעבודה עם נערות מתוך מטרה לסייע להן באיתור וזיהוי נערות בזנות ואכן לאחר ההכשרות נשלחו שאלונים למיפוי ואותרו עוד כ- 950 קטינות בזנות ע"י העובדות בפריסה ארצית של כ- 70 יישובים נוספים בישראל. מתוך הניסיון המצטבר למדנו כי יש פערים בתפיסות ובעמדות של אנשי מקצוע שונים ביחס למעורבות של בני נוער בזנות, ההגדרה עליה מתבססת עמותת עלם לקביעת מעורבות של נוער בזנות נקבעה עוד בקונגרס העולמי בשנת 1997 בשטוקהולם אולם לא תמיד היא מהוות קרקע לעבודת השטח בפועל בשירותים הפורמאליים למרות שהגדרה זו אומצה ע"י מדינת ישראל באופן רשמי. על כן, עבודת ההכשרה וההסברה מגבירה באופן דרמתי את המספרים של בני הנוער
המעורבים בזנות ומדווחים מידי שנה. כמו כן, יש לציין כי כל אותן נערת אותרו ע"י עובדות סוציאליות ייעודיות לעבודה עם נערות בלשכות הרווחה לאחר ההכשרות ועל כן יש לשער כי נתון זה הינו קצה הקרחון הידוע לנו אודות בני נוער וצעירות המעורבים בזנות בישראל. דו"ח מבקר המדינה מצטרף לדו"ח ההמלצות שפרסם משרד המשפטים בפברואר 2014 ובו פרוט אופרטיבי להמלצות עבור משרדי הממשלה בתחומי החינוך, האכיפה, הטיפול והחקיקה, דו"ח ההמלצות כלל גם את המלצות עמותת עלם בחמישה מוקדים עיקריים: א. נקיטת פעולות למניעת כניסת קטינים למעגל הזנות. ב. נקיטת פעולות לאיתור הגברת הזיהוי והאיתור של קטינים בסיכון לזנות. ג. נקיטת פעולות לאכיפה, מיצוי דין ויצירת הרתעה אפקטיבית כנגד המדיחים את הקטינים לזנות, לרבות תיקוני חקיקה להחמרת ענישה כנגד צרכני זנות קטינים. ד. פעולות לטיפול מזעור נזקים ושיקום הקטינים המצויים במעגל הזנות. ה. פעולות תומכות: הסברה, הכשרות ניטור, מדידה והגברת מודעות הציבור ואנשי מקצוע לזנות קטינים ולנזקיה. מבין שלל ההמלצות חלקן יושמו באופן חלקי וחלקן טרם, אולם יש לציין כי שיתוף הפעולה עם משרד המשפטים הנו הדוק ביותר. מבין ההמלצות בדו"ח זה המלצתנו למשרד המשפטים היתה לפעול למען תיקון החקיקה הנוגעת לצריכת מין מקטינים בישראל. 3.2. אכיפה והעמדה לדין - סעיף )3( 3 לפרוטוקול: דין לקוחו של קטין בישראל כיום הנו שלוש שנות מאסר, מה שלדעתנו גורע מההרתעה ומהאכיפה של עברה זו כלפי קטינים וקטינות המנוצלים בזנות. ניתן לראות מגמת עלייה קלה במספר החקירות אשר נפתחו בגין סעיפים 203 )ג( לקוחו של קטין ו 203 )ב( ניצול קטינים לזנות, אולם מספר החקירות וכפועל יוצא מתוכן מספר כתבי האישום עדיין זניח ביחס למספרים ההולכים וגדלים של בני הנוער המאותרים מידי שנה בזנות. נוסף על כך, גם המקרים אשר מבשילים לכדי כתבי אישום ניתן להתרשם מענישה ברף הנמוך ביותר משלל שיקולים ועל כן קשה להגדיר את האכיפה ומיצוי הדין בישראל כאפקטיביים וכמשביעי רצון. מנתונים רשמיים של מדינת ישראל אשר פורסמו ואף נשלחו לוועדה עולה כי בשנת 2014 נפתחו כ- 70 חקירות בעברות צריכת מין מקטינים וקטינות, מתוכן רק כ- 49 מתוכן הבשילו לכדי כתב אישום ואך ורק כ- 8 מהן הסתיימו בהרשעה ברף ענישה נמוך בהרבה מהרף המקסימלי הקבוע בחוק. נתונים אלו מחזקים את עמדת עלם כי יש להחמיר את הענישה הקבועה כיום בחוק ולבחון מדוע מערך האכיפה בישראל אינו אפקטיבי להתמודדות עם התופעה. מניסיון בעבודה עם נוער בזנות עולה שמבין הגורמים העיקריים המביאים למעורבות של בני נוער בזנות הם חוויה עמוקה של דחייה קיומית, התעללות רגשית, פיזית או מינית ועוד. מבין זירות הזנות הבולטות בישראל קיימות זירות פתוחות כגון אזור התחנה המרכזית בתל אביב, אזור חופי הים, אזורי תעשייה ומסחר, גנים ציבוריים. זירות סגורות כגון סאונות, מועדונים, ברים וליינים של מסיבות משתנות וזירת האינטרנט הפופולארית במיוחד בקרב בני

24 May 2015 Position Paper: Prostitution among Israeli Youth and Young Adults Prevention, Responses and Rehabilitation Submitted to the UN Committee on the Rights of the Child (CRC) UN CRC's review of Israel's initial report in relation to the implementation of the Optional Protocol to the Convention on the Rights of the Child on the Sale of Children, Child Prostitution and Child Pornography (OPSC) I. Elem Youth in Distress - Background ELEM Youth in Distress operates in 40 out of the 270 cities in Israel, providing support and psycho-social services to close to 20 thousand young boys and girls between the ages of 13-26 each year; these youth are in various distress situations across the risk spectrum. Several hundreds of all the youngsters being addressed are either reporting or suspected of being involved in prostitution in one form or another. ELEM operates programs for youth in prostitution since 2001, beginning with Tel Aviv area, which is a metropolis area with high concentrations of population living in social margins homeless youth and young adults, out of which some were involved in prostitution or sexually assaulted. In 2008, after receiving a financial grant from the Ministry of Social Affairs, the program was expanded to 2 additional major cities Haifa in the North of the Country, and Eilat Israel's most southern city, and a known tourist destination, which unfortunately means that it is one the cities with the highest concentrations of prostitution activity in the country. In 2013, an additional program was inaugurated in Petach Tikva - a program designated to address girls and young women in prostitution and activated as a joint venture funded by the Ministries of Social Affairs, the National Security Agency and the Local Authority (City of Petach Tikva) and led professionally by ELEM. The pro-
gram is based on a unique model developed by ELEM's professional teams, aimed at addressing the phenomenon of youth prostitution in mid-size cities, where we have learned that detecting, identifying and treating prostitution is extremely hard and challenging. All of the above programs are on-going and operated by ELEM, in full cooperation between with the Ministry of Social Affairs and Local Authorities. Some of the youngsters assisted by ELEM in these programs are met by our teams in the designated outreach programs, targeting youth in prostitution, and some through other of ELEM's responses for youth at risk, not designed to treat this specific population. The phenomenon of prostitution among youth tends to be undetected, underreported and is known to be hard to identify even by highly skilled and qualified youth workers. II. Youth in Prostitution in Israel main characteristics Official disaggregated data on the phenomenon is not available. Section IV below lists the data processed through ELEM activities. During the years of working with the youth we have learned that the leading causes to their involvement in prostitution are deep or traumatic rejection experiences, emotional, physical or sexual abuse etc. Many of the youth we encounter are dealing with multifaceted social marginalization, along with difficulties resulting from their cultural background of traditional or closed societies, from which they were already or afraid to be rejected. Among these youngsters we can refer to youth from Ultra-orthodox communities, Palestinian youth, Ethiopian immigrating youth etc. Youngsters from these groups are exposed to the risk of getting completely banished and persecuted if they will be identified as involved in prostitution, even if it is occasional and still at the beginning of the risk spectrum. To that difficulty we should add the challenges of reaching out and assisting them, due to the secluded nature of the traditional communities, leading us to assume that there is still a lot to be disclosed in regard to youth in those groups. Prostitution Scenes - The most obvious prostitution scenes in Israel are the Open Scenes such as the Central Bus Station in Tel Aviv, the Beach Area, commercial and
industrial centers and public parks. There are also Closed Scenes such as Sauna Rooms, Clubs, Bars and changing part lines. The internet scene is more popular among youth consumers, and is operated through virtual prostitutes "business cards" (virtual profiles) in the social networks, and in dating websites, online specific forums, webcam prostitution and private chat rooms. III. Implementation of the OPCS: Government responses - Identification, prosecution of offenders and prevention and rehabilitation services Enforcement and prosecution Article 3(3) According to the Israeli criminal law (article 203 of the Penal Code), consuming sexual services from a minor is a criminal offense punishable by 3 years in jail. ELEM's position is that this mild punishment diminishes the deterrence and poses a challenge to the enforcement of the law, exposing minor boys and girls to become sexually exploited. We can see a slight uprise in the number of investigations based on Article 203(c) - consuming sexual services from a minor, and 203 (b) exploiting a minor for prostitution, but overall, the total number of investigations and prosecutions to follow remains negligible, compered with the increasing numbers of youth identified as involved in prostitution every year. Furthermore, in the cases that do make it all the way to court and to indictment, the sentencing bar is low in most cases, for various reasons. It is therefore hard to say that both enforcement and judgment execution in Israel are effective or satisfactory. Awareness raising, Prevention and Social Services for victims Article 9(2)+ (3) Over the past 3 years, the state is making genuine and considerable efforts to get to the bottom of the problem and promote solutions aimed to reduce its scale. We are witnessing an encouraging increased demand from both governmental ministries and municipalities, to provide their social and youth workers and teams with professional training sessions, as well as specific outreach programmes and initiatives of joint efforts with civil society and think tank processes in order to promote appropriate and effective solutions for the problem at the municipal level.
An example for an extraordinary inter-sectorial cooperation is the establishing of a unique response for youth and young adults in prostitution in Tel Aviv that began operating during 2014. The program operates 24 hours a day, seven days a week and provides youngsters with a safe haven, including shelter, food, clothing and psychosocial assistance. The programme was developed by ELEM professionals, based on the accumulated experience gained through 10 years of working with youth and young adults in prostitution. The center is fully funded by the Ministry of Social Affairs in cooperation with the City of Tel Aviv and operated by ELEM. The project's annual operating budget is 5 million NIS. This amount enables us to provide an accessible response, which is professional and versatile, as required to meet the needs of reaching out and identifying youth involved in prostitution in the various known and unknown scenes of activity and to offer effective assistance to the youngsters in order to enable them to gradually leave the cycle of prostitution and facilitate integration back into education/work environment. In addition, there is a growing awareness within the Ministry of Social Services to the need for professional tools for the identification of youth in prostitution, establishing an inter-personal connection with the youth and providing the adequate services, according to their particular needs. As a result, Professional training for youth workers and other service providers at the municipal level were held during 2011-2012. The participants were youth and social workers, operating a variety of programs for youth at-risk nationwide. As a direct result of this training, there was a sharp increase in the identification by social works at the municipal level of teens and youngsters involved in prostitution activities, even in area in which this phenomenon was previously been considered non-existent. 471 girls and 124 boys were identified, the average age of is 16.7. The numbers clearly indicate an immediate need to develop and implement additional designated responses in the periphery and other less central locations. Following the outcomes of the above training, during 2014 Elem trained an additional 320 social workers employed by the Ministry of Social Affairs working with girls and young women at risk. The training focused on improving the workers's knowledge and skills in identifying, outreach abilities and assisting girls in prostitution. The training was then followed by handing them with questioners as part of the population's
mapping program. This nationwide outreach effort resulted in identifying and reaching out to an additional 950 underage girls in 70 cities all over the country. There is an urgent need to expand the therapeutic responses for youth in prostitution or at risk of becoming involved in prostitution, to additional local authorities in Israel, given the geographic limited spread of existing solutions as it seems to be a nationwide phenomenon. A Formal Inspection Report, published by the Israeli State Comptroller in 2014, reviewed 11 Local Authorities and the way they addressed the phenomenon of local Youth in Prostitution.. The report identified the difference between municipalities that were aware of the problem and be pro-active in their approach, by leading effective responses, to other municipalities that hardly take any steps towards detecting and identifying local youth in prostitution, let alone promoting any local initiative to address the problem or act to reduce it and assist the youngsters in distress as result of it. In February 2014 the Ministry of Justice submitted to the Government the findings and recommendations of an inter-ministerial committee on the topic of child prostitution. The report includes a list of elaborated operative recommendations for several Governmental Ministries to act in educating, reinforcing and promoting legislation. The report also adopts ELEM's recommendations in 5 major points: a. Take active steps in preventing minors from entering the cycle of prostitution; b. Act to increase the identification of and reaching out to minors, who are at risk of being involved in prostitution; c. Activate enforcement measures, follow through prosecution and create effective deterrence towards instigating actors in the prostitution scene who draw minors at risk to enter the prostitution cycle. This includes amending the existing legislation and increasing the severity of sever punishments against the customers of youth prostitution. d. Engage in activities of harm reduction, as well as rehabilitation programs for minors involved in prostitution. e. Supporting Action: Publications for increased awareness among the general public and professional people to the problem and the extent of the
damage it inflicts, Professional training for community and service providers, monitoring potential at risk population and evaluation of actions affectivity. Some of the above recommendations were partially implemented, and some are yet to be implemented. Throughout our years of operation on behalf of this population, we have came to terms with the realistic understanding that there are different perceptions to view and understand the issue, an inevitable result to the cultural diversities and backgrounds of the dedicated professionals, service providers and social workers. On our work we are operated according to the definition determined in the world congress in Stockholm in 1997, that although it was formally adopted by Israel, does not always constitutes a solid base for our work. In recent years, as a result of awareness raising efforts, including the training provided to social workers at the national and municipal levels, we are witnessing a dramatic increase in the numbers of reported cases of youth prostitution, which are all identified by the recently trained designated personnel for girls at risk. This leads us to believe that the above mentioned figures as reported, demonstrate only the tip of the iceberg in terms of the scale of this phenomenon among youth and young adults involved in prostitution in Israel. IV.
